This Policy describes the types of information we may collect from you ("you" or the "user") or that you may provide when you visit the website (the "Website") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to information EnergyNet collects on the Website, in email, text, and other electronic messages between you and EnergyNet, and when you interact with our advertising and applications on third-party websites and services. It does not apply to information collected by websites or services owned and operated by third parties.

  • Information about you or your company disclosed by you or your financial institutions necessary to establish your bid allowance;
  • Information about you from consumer-reporting agencies or other financial regulatory agencies;
  • records and copies of your correspondence and email address, if you contact us;
  • your responses to surveys or questions that we might ask you to complete for research purposes;
  • details of transactions you carry out through the Website and of the fulfillment of your orders and requests. You may be required to provide financial information before placing an order through the Website; and
  • your search queries on the Website.

You also may provide information to be published or posted on public areas of the Website, or transmitted to other users of the Website or to third parties (collectively, "User Contributions"). We strive to provide you with choices regarding the User Information you provide to us. We have created mechanisms to provide you with the following control over your information:

If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.

  • Promotional Offers from EnergyNet. If you do not wish to have your email address or other contact information used by EnergyNet to promote our own or third parties' products or services, you can opt-out by sending a request via our contact link below. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to EnergyNet as a result of a product purchase, warranty registration, product service experience or other transactions.

We do not control third parties' collection or use of your information and are not responsible for the privacy policy or practices of third-parties and their websites. This Policy only applies to information we collect from you while you are actively in session with us. If you should link to a third-party website from our website, we strongly encourage you to review and become familiar with that website's privacy policy. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

2.4. Accessing and Correcting Your Information.

You may request access to, correct or delete personal information that you have provided to us by sending a request via our contact link below. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

3. Other Data Policies and Protections

3.1. Data Security.

We have implemented measures designed to secure your User Information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Our employees have access to your nonpublic personal information only on an as-needed basis. We conduct regular internal audits of our business procedures, examining confidentiality standards and information access in order to protect your personal information. In addition to our own review, we are subject to periodic compliance review by FINRA.

It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers.

3.3. California Privacy Rights.

California Civil Code Section Ss. 1798.100 et seq. permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Additionally, if you reside in California, are under 18 years of age, and have an account on the Website, you may request removal of information publicly posted by you on the Website. To make either such request, please send us a request via our contact link below that includes any email address associated with your account and a statement that you reside in California. We will make sure the requested information is not displayed publicly on the Website; however, some information may not be completely removed from our systems.

3.4. International and Federal Privacy Rights.

The Gramm-Leach-Bliley Act obligates EnergyNet to provide the information contained in this Policy and the mechanism available to you to opt out of any retention or disclosure of nonpublic information. EU General Data Protection Regulation 2016/679 requires that EnergyNet disclose the type of personal data processed and disclosed under this Policy. By continued use of the Website, you consent to the terms of this Policy. If you wish to request the removal of any information, please send us a request via our contact link below.

3.5. Do Not Track Technology.

Some web browsers have a "Do Not Track" feature to transmit your preference not to have data about your online activities tracked. Currently, we do not respond to "Do Not Track" or similar signals, as there is no uniform standard for responding to such signals. We will inform you of any future amendments to this Policy due to changes in Do Not Track standards in an updated Privacy Policy.

3.6. Children Under the Age of 16.

Our Website is not intended for children under 16 years of age. No one under age 16 may provide any information to or on the Website. We do not knowingly collect personal information from children under 16.
