P: The land covered by this oil and gas lease contains an archaeological, or paleontological resource which may need to be protected. Lessee shall not disturb the surface of the leased premises until the provisions of this addendum are satisfied. At least 20 days prior to any surface disturbance of the leased premises, the lessee shall notify the North Dakota Department of Trust Lands of the location of the intended surface disturbance and what the disturbance will entail. The Department of Trust Lands, after considering advice from the State Historical Board or the North Dakota Geological Survey will determine what, if any, protection of the resource shall be necessary before allowing access to the area intended to be disturbed. If the lessee objects to the requested protection, the lessee may present its objection to the Department of Trust Lands.
