At the close of auction, you will be required to sign a settlement sheet indicating you accept any liability for your actions on these tracts, and agree to these terms. Please refer to the Terms and Conditions of a Department of Trust Lands lease for details.

Notice

AGE REQUIREMENT:

Lessees must be 18 years of age or older, under ND state law.

LEASE APPROVAL:

Leases are not valid until approved by the Land Commissioner and will become effective January 1 or retroactive to January 1.

ACCESS:

The North Dakota Department of Trust Lands does not guarantee access to tracts available for lease.

Rent / Payments

Bidding will begin at the advertised minimum; these vary by region of the state and quality of the tract. If a lease is bid-up, the bid-up rent will be due each year of the lease. Payment for tracts is due within 10 (ten) days following this auction. All subsequent lease payments will be due prior to January 1 throughout the term.

Maintenance and Improvements

TRACT MAINTENANCE:

Except for cropping and improved hayland acres specifically authorized on the lease document, school trust lands are leased for pasture and meadow purposes only, and must be maintained in good range condition. Weed control is required and cost share is available. Third Party Use is not allowed without written permission from the Department. If your tract is adjacent to a winter maintained road, you are responsible for the mowing, according to township or county specifications. These lands are open to NON-vehicular public access. You may not post “NO Hunting/Trespassing” signs. Approved signs are available through our Bismarck Department of Trust Lands office only and are free of charge.

NON-PERMANENT IMPROVEMENTS:

Unless specifically stated otherwise, non-permanent improvements are property of the current lessee, who has 120 days after lease expiration (December 31) to remove them (in their entirety) or make arrangements with a new lessee for the sale or lease of the non-permanent improvement. EX: Fences, windmill, water tank, submersible pump in a well.

Successful Bidder Notification

At the close of auction, the successful bidder will be notified via email with closing instructions, including total amount due.

Payment to the State of North Dakota must be confirmed by email to dtlsurface@nd.gov on the day of the sale, and payment completed within 10 (ten) days.

Buyer Premium

A 3% Buyer Premium, calculated as 3% of the total rental bid, will be added to the cost of this lease.

North Dakota received $1.25 billion from the Coronavirus Relief Fund as part of the $2.2 trillion Coronavirus Aid, Relief, and Economic Security (CARES) Act. The North Dakota Emergency Commission and Budget Section Interim Committee approved the Department of Trust Lands requested funding on behalf of our lessees to cover the 3% EnergyNet Buyer Premium.
